1. Acceptance of Terms
By accessing or using Session Flo ("the Service") at sessionflo.com, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you must not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.
Session Flo is operated by Session Flo ("we", "us", or "our"). We reserve the right to update these Terms at any time. We will notify you of material changes via email or a prominent notice on the platform. Continued use after changes take effect constitutes acceptance of the updated Terms.
2. Description of Service
Session Flo is a web-based platform that enables facilitators, educators, and teams to run interactive sessions using tools such as live polls, quizzes, icebreakers, word clouds, and collaborative agendas. Participants can join sessions via a link or code without requiring an account.
We offer both free and paid subscription tiers. Features available on each tier are described on our Pricing page and may change from time to time.
3. Accounts and Registration
3.1 Eligibility
You must be at least 16 years old to create a Session Flo account. By registering, you confirm that you meet this requirement. If you are under 18, you confirm that you have obtained parental or guardian consent.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorised access to or use of your account.
3.3 Accurate Information
You agree to provide accurate, current, and complete information when registering and to keep your account information up to date.
4. Subscriptions and Payments
4.1 Free Plan
Session Flo offers a free plan with limited features. No payment information is required to use the free plan.
4.2 Paid Subscriptions
Paid subscriptions are billed on a recurring basis (monthly or annually) as selected at checkout. Payment is processed by Stripe. By subscribing, you authorise us to charge the payment method on file at each renewal period until you cancel.
4.3 Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods, except where required by applicable law.
4.4 Price Changes
We reserve the right to change our subscription prices. We will give you at least 30 days' notice of any price increases before they take effect. If you do not agree to a price change, you may cancel before it takes effect.
5. Acceptable Use
You agree to use Session Flo only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Attempt to gain unauthorised access to any portion of the Service or its related systems.
- Use automated tools (bots, scrapers, crawlers) to access or collect data from the Service without our prior written consent.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service in any way that could disable, overburden, damage, or impair the Service or interfere with other users' use.
- Upload or transmit viruses or any other malicious code.
- Violate any applicable laws or regulations.
We reserve the right to suspend or terminate accounts that violate these rules, without notice and at our sole discretion.
6. Content and Intellectual Property
6.1 Your Content
You retain ownership of all content you create and upload to Session Flo ("Your Content"), including session questions, polls, and responses. By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely as necessary to provide the Service.
You are solely responsible for Your Content and represent that you have all necessary rights to submit it and that it does not infringe any third-party rights.
6.2 Our Intellectual Property
The Session Flo platform, including its design, software, logos, trademarks, and all associated intellectual property, is owned by us or our licensors. Nothing in these Terms grants you any right to use our intellectual property except as expressly permitted.
7. Privacy
Your use of Session Flo is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.
8. Third-Party Services
Session Flo integrates with third-party services such as Google Calendar, Microsoft Outlook, and Stripe. Your use of those integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the practices of third-party service providers.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any information obtained through the Service will be accurate or reliable.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SESSION FLO, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) £100.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Session Flo and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) Your Content; or (c) your violation of these Terms or any applicable law.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, us, or third parties, or for any other reason at our sole discretion. You may delete your account at any time from your account settings.
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and limitation of liability) will remain in effect.
13. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer in the European Union, you may also benefit from any mandatory provisions of the law of the country in which you reside, which cannot be derogated from by agreement.
14. General
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
- Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights at any time.
